Riverstone Los Banos Asphalt Paving provides asphalt paving, sealcoating, crack sealing, pothole repair, parking lot striping, grading, and related services for residential and commercial customers in Los Banos, CA and the surrounding area. The specific scope of work for each project is defined in a written estimate or work order provided to the customer before work begins. Services not listed in the written estimate are not included unless agreed to in writing.
All estimates are provided in writing following an on-site assessment of the project. Estimates are valid for 30 days from the date issued unless otherwise stated.
Estimates are based on conditions observed at the time of the site visit. If conditions change before or during the project - including but not limited to discovery of unexpected base failures, soil conditions, drainage issues, or changes in material costs - we will notify you and provide a revised estimate before proceeding with any additional work.
Final pricing is based on the agreed written estimate. We do not charge for on-site estimate visits.
Project dates are confirmed once an estimate is accepted and any required deposit is received. Scheduling is subject to crew availability, weather conditions, and material lead times.
We reserve the right to reschedule work due to weather or other conditions outside our control (including rain, extreme heat, or events that affect curing conditions). We will notify you as soon as possible if a reschedule is necessary.
If you need to cancel or reschedule your project, please contact us at least 48 hours in advance. Cancellations made after work has begun may be subject to a charge for work completed and materials already ordered or delivered.
Payment terms are specified in your written estimate. In general, a deposit may be required to schedule your project, with the remaining balance due upon completion of work. We accept payment by check, cash, or other methods as noted on your estimate.
Payment is due at the time of final completion unless alternative terms are agreed to in writing. Invoices not paid within 30 days of the due date may be subject to a late fee. Accounts that remain unpaid may be referred for collection, and the customer is responsible for any associated collection costs.
We do not require full payment upfront before work begins. If any contractor asks for full payment before starting, that is a red flag and not our practice.
We stand behind our workmanship. If a defect in our work becomes apparent within a reasonable time after project completion, contact us and we will assess and address it.
However, we do not warrant against damage caused by conditions outside our control, including but not limited to: expansive soil movement, tree root intrusion, acts of nature, flooding, vehicle loads exceeding the design capacity of the surface, or damage caused by third parties after project completion.
Asphalt is a natural material subject to weathering over time. Normal aging, minor surface oxidation, and hairline cracking that develops over years of exposure are not covered under any workmanship warranty. Regular maintenance including periodic sealcoating and prompt crack repair extends the life of your surface and is the responsibility of the property owner after project completion.
To the fullest extent permitted by law, Riverstone Los Banos Asphalt Paving is not liable for any indirect, incidental, special, or consequential damages arising from our services or from your use of our website, including but not limited to lost profits, loss of use, or damage to property not directly caused by our negligence.
Our total liability to you for any claim arising from our services is limited to the amount paid by you for the specific work at issue. This limitation applies regardless of the legal theory under which a claim is brought.

After work is complete, you are responsible for following the cure time guidance provided by our crew and keeping vehicles and heavy equipment off new asphalt for the time period specified.

If a dispute cannot be resolved informally, the parties agree to attempt good-faith mediation before pursuing any legal action. Any claims that proceed to court will be resolved in the courts of Merced County, California, and both parties consent to that jurisdiction.
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action or proceeding relating to these terms or our services shall be brought in the appropriate courts of California.
